Terms of use

These are the terms for using TubNudge, the hot tub maintenance app, and this website. TubNudge is made by Blerdev LLC, a Kansas company ("we", "us"). By installing or using TubNudge you agree to these terms. If you do not agree, please do not use the app.

What TubNudge is

TubNudge keeps a maintenance schedule for your hot tub, reminds you when a task is due, and keeps a record of what you did, including soaks and the water test readings you write down. You may install and use it on your own devices for your own tubs.

What TubNudge is not

TubNudge is a reminder and record-keeping tool. It is not professional advice.

• It does not tell you how much of any chemical to add. Always follow the label on your product and your hot tub's owner's manual.
• Schedules are starting points. Intervals come from general guidance and, where available, the manufacturer's published figures. Your manual and your own tub come first, and you can change any interval.
• Ideal ranges are general figures. When TubNudge marks a water test reading as low, in range or high, it compares it with common hot tub ranges, not with your product's own instructions. It does not read test strips.
• Ask TubNudge can be wrong. Its answers are written by an AI model. Treat them as general information, check anything important against your manual or with a professional, and do not rely on them for safety or health decisions.
• Reminders can be late or missed. Android, battery settings and a phone that is off or without a signal can delay or stop a notification. Do not rely on TubNudge as your only safeguard for anything that matters.

You are responsible for the care, safety and water quality of your hot tub.

Accounts

TubNudge works without an account. If you choose to sign in with Google, you are responsible for what happens under your account, and you can delete the account and everything stored with it from the Account screen at any time. Accounts are for adults. How your data is handled is described in the privacy policy.

TubNudge Pro

Most of TubNudge is free. TubNudge Pro adds further features and is sold through Google Play, either as a yearly subscription or as a one-time lifetime purchase. The price and any free trial are shown on the purchase screen before you buy.

• The yearly subscription renews automatically each year, at the price shown, until you cancel. A free trial becomes a paid subscription when it ends unless you cancel before then. You cancel in Google Play, under Payments and subscriptions; cancelling stops the next renewal and you keep Pro until the end of the period you paid for.
• The lifetime purchase is one payment and covers Pro for as long as TubNudge is offered. Features that cost us money each time they are used, such as Ask TubNudge, have monthly limits, which the app shows.
• Payment and refunds are handled by Google Play under Google's terms and refund policy. If something went wrong with a purchase, write to us and we will help where we can.
• When Pro ends, the Pro features lock again. Nothing you entered is deleted, and the free features keep working.

We may change what Pro includes or what it costs. A price change does not affect a period you have already paid for.

Sharing a tub

With Pro you can invite other people to a tub. Everyone you invite can see that tub's data and add to it, and they join free. You are responsible for whom you invite, and you can remove a person or stop sharing at any time. If you were invited to someone else's tub, its owner decides how long you have access.

Your data

What you enter is yours. You can export it to a file whenever you like. You give us permission to store and process it only as needed to run the features you turn on: backup, sync, sharing and Ask TubNudge.

Fair use

Please do not misuse TubNudge: do not try to break into or overload our server, get around the limits on Pro features or Ask TubNudge, use the app to harm other people, or resell it. We may suspend an account that does.

Changes and availability

We work to keep TubNudge running and improving, and it may receive updates automatically. We may add, change or remove features, and we may stop offering the app or its online features. If we ever shut down the online features, we will give notice in the app or on this site where we reasonably can, and the data on your phone stays yours to export.

No warranty

TubNudge is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the app will be uninterrupted or free of errors, or that its reminders, schedules, ranges or answers are accurate or suitable for your hot tub.

Limit of liability

To the fullest extent the law allows, Blerdev LLC is not liable for indirect, incidental, special or consequential damages, or for damage to a hot tub, property or health arising from the use of TubNudge. Our total liability for any claim about TubNudge is limited to the amount you paid us for it in the twelve months before the claim, or US$30 if that is greater. Some places do not allow some of these limits, so they may not all apply to you.

Governing law

These terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Kansas, unless the law where you live gives you the right to bring it elsewhere.

Changes to these terms

If we change these terms, the date above will change, and for a change that matters we will say so in the app or on this site. Using TubNudge after a change means you accept the new terms.
